An expert witness is a person with specialized skill sets whose opinion may help a jury make sense of the factual evidence of a case. Expert witnesses provide independent opinions based on the information that is provided to them using their technical knowledge, experience, and skills. Once formally retained, an expert witness will receive the case records from the attorney and a review of the documents will be requested. The law firm may then schedule a follow-up conversation regarding opinions on the information provided. Depending on those opinions, the firm may request an expert work product, such as a written report or Affidavit of Merit. Alternatively, the firm may decide to decline the case or pursue alternative opinions if the expert does not feel they can support the case in good faith. As the case progresses, an expert may also be called to sit for a deposition and provide expert testimony at trial.
